Law establishing measures to safeguard the rights of workers affected by legal measures due to COVID-19

 

The referenced law establishes measures for the compensation (make-up) of working hours for workers in both the private and public sectors who were affected by various legal provisions issued during the state of emergency.

In this regard, it is specified that the accumulation of hours of paid leave generated as a result of such legal measures may be compensated in the following ways: (i) through overtime work performed before or after the regular workday, as well as through training outside working hours, provided that it does not exceed two (2) hours per day; (ii) through accrued and unused vacation leave, where each vacation day used for compensation will be equivalent to three days of paid leave. No more than 15 days may be compensated.

Likewise, it is established that within fifteen (15) days of this law entering into force, employers must notify workers in writing of the total number of paid-leave hours owed.

Finally, the law prohibits making deductions from the final settlement of employment benefits upon termination of the employment relationship as compensation for the paid-leave hours.
