Supreme Decree No. 005-2025-MINCETUR

APPENDICES 2, 2A AND 5 OF ANNEX II OF THE TRADE AGREEMENT BETWEEN THE EUROPEAN UNION AND ITS MEMBER STATES, ON THE ONE HAND, AND COLOMBIA, PERU AND ECUADOR, ON THE OTHER, ARE AMENDED; REGARDING THE DEFINITION OF THE CONCEPT OF ORIGINATING PRODUCTS AND METHODS FOR ADMINISTRATIVE COOPERATION

The Trade Agreement between the European Union and its Member States, on the one hand, and Colombia, Peru and Ecuador, on the other (hereinafter, the Trade Agreement) was signed on 26 June 2012 in the city of Brussels, Kingdom of Belgium, approved by Legislative Resolution No. 29974, and ratified by Supreme Decree No. 006-2013-RE, dated 17 January 2013. It should be noted that the Trade Agreement aims to promote a balanced free trade area and improve investment between regions.

By virtue of Article 13(2)(g)(iii) of the Trade Agreement and Article 37 of Annex II thereto, it is provided that the Trade Committee may amend said Annex.

In that regard, in order to update the provisions of the Trade Agreement in line with what is regulated by the Convention on the Harmonized System of Designation and Coding of Goods, updated in 2022, since what is regulated in the Trade Agreement is based on the nomenclature of the 2012 and 2017 versions.

Consequently, some of the amendments to the Trade Agreement are based on the following:

  1. Correction of certain spelling and drafting errors in Appendices 2, 2A and 5 of Annex II of the Agreement; likewise, they must be amended to reflect changes in the wording of the chapters, headings or subheadings of the 2022 Harmonized System (HS).
  2. Amendment of Appendix 2 of Annex II (List of working or processing required on non-originating materials for the transformed product to obtain originating status), regarding the product-specific rules of origin for products under HS headings 1601, 1602, 2404, 3006, 3816, 3822, 3827, 8479, 8524, 8529, 8539, 8541, 8548, 8549, 8806 and 9021 of the updated Harmonized System.
  3. Amendment of Appendix 5 (Products to which subparagraph (b) of the European Union Declaration relating to Article 5 applies, in relation to originating products from Colombia, Ecuador and Peru), linked to updating the designation and codes of certain products under HS headings 0303, 0307 and 1605, in accordance with the latest version of the EU Combined Nomenclature and TARIC codes.

This provision shall be implemented as from 18 August 2025.
