Legislative Decree No. 1053 approved the General Customs Law and, subsequently, Supreme Decree No. 010-2009-EF approved its Regulations, which establish the provisions applicable to foreign trade operators and to the procedures related to their authorization and operation.
Therefore, in order to optimize customs regulation, it is necessary to standardize the authorization period applicable to foreign trade operators, adapt the requirements for the accreditation of customs representatives and customs clearance assistants, and simplify certain obligations applicable to foreign trade operators.
Accordingly, the following are among the main amendments:
- The authorization period for foreign trade operators is standardized at five (5) years, except for postal service companies and public entities, whose authorization remains indefinite.
- The requirements for the accreditation of customs representatives and customs clearance assistants are amended, specifying that certification may be obtained through programs provided by SUNAT or by educational institutions, in accordance with the regulations established by the Customs Administration.
- Condition C.1 of Annex 1 to the Regulations is amended by eliminating the obligation to publish on the corporate website information that is already publicly available, while maintaining the requirement to have service traceability mechanisms and procedures for handling complaints and claims.
