THE SPECIFIC PROCEDURE “IMPORTATION OF GOODS SUBJECT TO THE AMENDING PROTOCOL TO THE PERUVIAN–COLOMBIAN CUSTOMS COOPERATION AGREEMENT” DESPA-PE.01.13 (VERSION 3) IS APPROVED
By means of Superintendency Resolution No. 000106-2021/SUNAT, the specific procedure “Importation of goods subject to the Amending Protocol to the Peruvian–Colombian Customs Cooperation Agreement” DESPA-PE.01.13 (Version 2) was approved, which sets out the guidelines to be followed for the customs clearance of goods destined for the import-for-consumption regime that benefit from the Amending Protocol to the Peruvian–Colombian Customs Cooperation Agreement.
Subsequently, in order to adapt to the operations of the Chancay Multipurpose Port Terminal, to incorporate the Port of Chancay as an authorized place for the indirect entry of goods into the zone established in the Agreement, and to establish that—in such case—the submission of a bank or financial guarantee letter ensuring payment of the import taxes on goods destined for consumption in said zone shall be made before the Chancay Customs Intendancy, the Regulations of the General Customs Law were amended and, consequently, Article 2 of Supreme Decree No. 15-94-EF—which sets out measures to ensure compliance with the obligations assumed by Peru under the Customs Cooperation Agreement with Colombia—was amended, as well as Article 1 of Supreme Decree No. 029-2001-EF.
Accordingly, in order to align with the regulatory changes mentioned above, it is necessary to approve a new version of the specific procedure “Importation of goods subject to the Amending Protocol to the Peruvian–Colombian Customs Cooperation Agreement” DESPA-PE.01.13. This is intended to streamline the process for goods entering the zone covered by said Agreement, optimize the process for obtaining the benefit from the numbering of the electronic regularization/physical recognition request up to the registration of the completion record, and likewise to regulate the transfer of goods to common taxation zones and special taxation zones, passing through a common taxation zone.
