RESOLUTION No. 146-2026/CDB-INDECOPI – INITIATION OF AN EXPIRY REVIEW PROCEEDING CONCERNING ANTIDUMPING MEASURES ON IMPORTS OF FOOTWEAR, WITH CERTAIN EXCEPTIONS, ORIGINATING IN THE PEOPLE'S REPUBLIC OF CHINA

Through Resolution No. 205-2022/CDB-INDECOPI, the antidumping duties applicable to imports of all types of footwear (except flip-flops and sandals) with uppers made of rubber, plastic, or natural leather, originating in the People’s Republic of China, were maintained in force for a five-year period.

As the expiration of these measures approached, the Leather, Footwear and Related Products Corporation, together with several domestic companies, requested the initiation of an expiry review proceeding (sunset review), in order to assess whether they should remain in force.

Therefore, INDECOPI’s Commission on Dumping, Subsidies and Elimination of Non-Tariff Trade Barriers determined that the application met the requirements established under the WTO Anti-Dumping Agreement and the Anti-Dumping Regulations, finding that the removal of the duties could lead to the continuation or recurrence of both dumping and injury to the domestic industry. The main factors considered include the following:

  • Increase in imports of Chinese footwear during the 2022–2025 period.
  • China’s significant export capacity as an indication of the likelihood of continuation or recurrence of dumping.
  • Vulnerability of the domestic industry to a potential increase in imports at dumped prices.
  • Maintenance of antidumping duties on footwear originating in China by Argentina, Brazil, and Mexico.

Accordingly, this Resolution orders the initiation of the expiry review proceeding (sunset review) concerning the antidumping duties applicable to imports of footwear originating in the People’s Republic of China and establishes that such duties will remain in force for the duration of the review proceeding.
