Through Law No. 32527, Congress delegated to the Executive Branch the authority to enact legislation, for a period of 60 calendar days, on matters related to public safety, the fight against organized crime, responsible economic growth, and institutional strengthening.<\/p>\n
In this context, and in order to establish alternative measures to the forfeiture (seizure) sanction applicable to goods transported in transit to other destinations abroad, or subject to the transshipment regime, when such goods have not been declared in the cargo manifest or do not match the description stated therein, it is necessary to amend Articles 103 and 200 of Peru\u2019s General Customs Law (approved by Legislative Decree No. 1053).<\/p>\n
Accordingly, this Legislative Decree amends Article 103 and subsection (k) of Article 200 of Peru\u2019s General Customs Law, in order to allow\u2014under certain conditions\u2014the carrier or its in-country representative to opt for the imposition of a fine in lieu of the forfeiture (seizure) sanction otherwise applicable to goods on board a means of transport that are in transit to other destinations abroad or intended for the transshipment regime, when such goods have not been declared in the cargo manifest or do not match the description stated therein.<\/p>\n
It should also be noted that, within 45 calendar days from the publication of this Legislative Decree, a Supreme Decree will be issued approving amendments to align the Regulations of Peru\u2019s General Customs Law and the Schedule of Penalties applicable to the infringements set forth in such Law. Accordingly, this Legislative Decree will enter into force on the effective date of the Supreme Decree referred to above.<\/p>\n
