Within the framework of an investigation initiated at the request of the domestic steel-producing company, INDECOPI\u2019s Commission on Dumping, Subsidies and the Elimination of Non-Tariff Trade Barriers assessed the existence of dumping practices in imports of non-alloy steel wire rod, low- and high-carbon, of circular cross-section and smooth surface, with a diameter ranging from 5.5 mm to 16 mm, originating in the People\u2019s Republic of China. The proceeding was conducted in accordance with the provisions of the WTO Anti-Dumping Agreement, including the investigation stages, participation of interested parties, and evaluation of evidence.<\/p>\n
As to the merits of the dispute, the proceeding found that domestically produced wire rod and wire rod imported from China constitute like products, as both share the same physical characteristics and end uses, are manufactured from the same raw materials through the same production process and marketed through the same channels, and are classified under the same tariff subheadings.<\/p>\n
Based on the analysis conducted for the period from July 2023 to June 2024, the Commission determined the existence of dumping practices in exports to Peru of the product referred to above, as well as a substantial increase in the imports under investigation, both in absolute terms and relative to domestic consumption and domestic production. This negatively affected the product\u2019s selling prices and the domestic industry\u2019s performance, as relevant economic and financial indicators showed an unfavorable trend during the analysis period (July 2021 to June 2024). No other factors were identified that would explain the material injury experienced by the domestic industry during that period. Accordingly, a causal link was found between the dumped imports and the material injury suffered by the domestic industry, with no other factors accounting for such harm.<\/p>\n
Accordingly, this Resolution orders the imposition of definitive anti-dumping measures on imports of wire rod originating in China for a period of five (5) years, establishing differentiated specific duties depending on the level of cooperation of the exporters under investigation, with the aim of preventing such imports from continuing to cause material injury to the domestic industry during the period under analysis.<\/p>\n
